Foos v. Ann Inc., Case No. 3:11-cv-02794-L-MDD
A settlement has been reached in a lawsuit involving Ann Inc., operator of Ann Taylor, LOFT, Ann Taylor Factory and LOFT Outlet stores located in California. The Court in charge of the case is the United States District Court for the Southern District of California (San Diego). The case is known as Foos v. Ann Inc., Case No. 11-cv-02794-L (MDD). The Court has certified a Class consisting of all individuals who reside in the United States who made a credit card purchase at a California Ann Inc. store between September 30, 2010 and September 13, 2012, and an Ann Inc. store employee requested and recorded personal identification information during such credit card purchase transaction.
What does the Settlement Provide?
Class Members may elect to receive either a voucher for $15 off of a merchandise purchase (no minimum purchase required) or 20% off any merchandise purchase (no cap).
In addition to the benefits described above, the Defendant has also agreed to other relief and certain future conduct. The Defendant has agreed to change its policies, practices, and procedures to comply with California Civil Code section 1747.08.
Class Member Options
| SUBMIT A CLAIM FORM | You may have submitted a Claim Form electronically via this website or by mail postmarked no later than February 8, 2013. |
| EXCLUDE YOURSELF | If you wanted to exclude yourself from the Class Action, you must have formally requested to exclude yourself by sending a letter to the Claims Administrator. The letter must have been postmarked on or before November 20, 2012. |
| OBJECT OR COMMENT | Any Settlement Class Member who wished to object to or to have opposed the approval of this Settlement and/or the Fee and Cost Application must have filed a written objection with the Court and served it on the Parties by November 20, 2012. |

Fairness Hearing
On December 10, 2012 at 10:30 a.m., the Court approved the Settlement at a hearing held on the fairness of the proposed settlement. At the hearing, the Court heard any objections and arguments concerning the proposed settlement’s fairness. The hearing took place before the Honorable M. James Lorenz in Courtroom 14 (5th Floor) of the U.S. District Court for the Southern District of California, located at 940 Front Street, San Diego, CA 92101.
